Hard to say, she has said she was friends with the artist and so thought a contract between them wasn't necessary.
This, and also the artist is in a different country, so even if there had been a contract, it would almost certainly be unenforceable.

That's an unexpected (bad) surprise! Fiona sent me 2 postcards from the deck...(I just asked for one), really lovely. I was so looking forward to this deck. I'm a backer, and she emailed that she'll refund people (starting with the those people who paid a higher price - I backed one deck only so there is a very slim probability that I'll ever get the money back)(the artist of the Symbolist tarot made SO many promises after his project came to nothing, none kept). This is the 3d time I am backing a project and ending on the looser side...good that there is an AT where we can share our disappointments (and happy tarot moments as well)

Lunar Fire facebook is closed too...

ETA in my opinion she should refund first the shipping cost to everyone (the money not spent - she should have that) before slowly starting to refund people. (I just suppose it'll be 'slowly' as I guess otherwise she would've not said that she'll refund those who paid a high price first as it would take just a few days to make the refund to everyone)

But Richard (symbolist) never suggested a refund, just said he would find a way to get us our decks. the only other one I've had trouble with is the Eldritch - have other KS ones gone wrong too ?[FONT=&quot][/FONT]

Yah, no refund, but promises re. deck. In the end not even a scan.
Book of Shadows-the lost code of tarot. I backed for $55, it was sold on Amazon for $21 and on top of that one could get it months before the backed copies were sent.

It could have been a beautiful deck. Very disappointing. We should all agree to ring the alarm bells if the artwork turns up unauthorized somewhere else. This was my first (and last) time supporting a crowd funding project.

I have already told Fiona I will do exactly that.

But let's also not use this thread to damn all such projects. I have backed MANY that were VERY successful, too.

Thank you everyone for the kind words through this ordeal. To clear some of the smoke (because you do all deserve answers).

Nghia and I met years ago when I was a fiverr tarot reader and he was a fiverr artist. It was kind of a freak accident that we ended up creating this deck. It's been a 2-3 year work in progress.

However, the raw files without watermarks were never released to me. I didn't think it was a problem because I wouldn't need them until it came time to print.

He got married around Oct-Nov. We had been working on the project for so long we decided it was time for it to be done with. He gave me a price for the remainder of the cards PLUS cost of living in Vietnam. This would have paid for him to work on the deck and only the deck for two months- which is why he was paid up front.

My idea for a contract was that at the end of the project, he would sign all rights to the artwork over to me (he wanted nothing to do with it after we were done). Since he was in Vietnam and I was in Japan (and now stateside), we felt that this was the easiest way to go about it.

That two months went by and he mentioned arthritis. Then he mentioned computer failures. Then health issues in his family. We were already way behind because of his issues and then in May, all messages ceased. His father was passing and as I am writing this- has recently passed away. HOWEVER- I had already known about this. He had known about this, for months, and I have in his writing that he had been expecting this passing for a while now.

At the end of the day, he had a job to do and I had a promise to fulfill to Kickstarter backers. Since he is no longer responding to me (it's been two months) my only option is to refund the money.

Unfortunately, a large portion was paid to him and he has not responded to my invoices for a return. Kickstarter and processing fees along was a few thousand. I also purchased some of the perks already (Red cloth, postcards, and posters) because I was aware that printing times and shipping could be ridiculous.

Because I dont have any of the raw files, I can't even hire a new artist to pick up where he left off. He has told me over and over that I will get them and I haven't.

I do apologize for the let down. This sucks. I really hate disappointing people and I am just so grateful how understanding everyone has been.

I know the refund is taking a while, but I will be paying a lot of it out of pocket- but if you want one, you will get one. It may just take a few months.

I am so sorry Fiona. How horrible for you. Trusting someone can be difficult at the best of times. You have been very let down and must feel these wounds have cut very deeply.
Hopefully at some stage your artist will come to his senses and at least release the artwork to you.

I was a backer for this kickstarter, and was very much looking forward to seeing in my hands what looked to be a beautifully moving deck. While I am sad that it will not be completed after all this time, I feel that Fiona has communicated with her backers and dealt with this unfortunate situation in a thoroughly professional manner.

Fiona - you had mentioned "My idea for a contract..." - did you and Nghia end up drafting and signing a contract? I hope you would be able to have some recourse in this matter if so, although it being international could prove to make things even more difficult.

My refund posted to my bank on the 7th. As far as my interactions have indicated, Fiona is true to her word and I hope this incident does not put others off from backing such works of art as she envisioned. Fiona, if you at some point in the future think you can bring this deck to fruition, I would most definitely back it again.
